What is Article 126-1 of the Tax Code?

Article 126-1 of Colombia's Tax Code establishes that voluntary contributions to mandatory pension funds, voluntary pension funds, and AFC accounts (Savings for Construction Promotion) are deductible from taxable income, up to 30% of annual gross labor income and no more than 3,800 UVT (approximately 189 million pesos at the 2025 UVT value). That limit is combined: voluntary pension contributions plus AFC. If you already have a mortgage, the combined cap remains the same 30% or 3,800 UVT.

What that looks like in actual pesos

For a person earning 5 million pesos a month (60 million a year), 30% amounts to 18 million annually. If you contribute that amount to a voluntary pension fund or AFC account, you reduce your taxable income by 18 million. With a marginal rate of 19% (the second bracket under Article 241), that is a tax saving of 3.42 million pesos per year. For someone in the 28% bracket, the saving climbs to 5.04 million. And the money does not disappear: it keeps growing in the fund.

AFP, voluntary pension, or AFC account: which one to use?

Voluntary contributions to your mandatory AFP (such as Protecci贸n, Porvenir, Colfondos, or Skandia) go directly into your pension savings account and are invested alongside your mandatory contributions. Voluntary pension funds are separate vehicles with greater withdrawal flexibility (under tax conditions) and more portfolio options. An AFC account is offered by a financial institution and the money must be used to purchase housing, but can be withdrawn without that purpose (paying taxes on the portion not used for housing). All three carry the same tax benefit under Article 126-1.

Withdrawal rules you should know

The tax benefit comes with a condition: the money must stay in the fund until retirement or be used for housing (in the case of the AFC). If you withdraw it before that without meeting those conditions, the DIAN charges a 7% withholding on the amount withdrawn, which effectively claws back the benefit you received. For voluntary pension funds, withdrawal is free after 10 years without penalty, even if you have not retired. This makes them an attractive medium-term savings vehicle with an immediate tax benefit.

Calculate your tax saving and your projected balance

The voluntary pension savings calculator takes your monthly gross salary, the amount you would contribute, your age, and the fund's expected return. It shows you the annual tax saving, the marginal rate that applies in your case, the real net cost of the contribution (contribution minus tax saving), and the projected fund balance over time. It is the fastest way to know whether it is worth making that contribution this year, before the tax period closes.
